Photography Agreement
Photography
1. WEDDING PHOTOGRAPHY ORDER: This signed Contract constitutes an order for wedding photography in the form of photographs and/or album. All sales are final. Client's acceptance of the wedding photography package or leaving with the photographs and/or album or accepting delivery of the same, signifies Client's complete satisfaction with the package. There are no oral or other agreements of the parties hereto and this Contract constitutes full and complete understanding and agreement between the Client and the Photographer. Changes to an album after delivery will be at a rate of $100 per hour with a minimum of $300. Damages to an album or photographs during or because of shipment will be the responsibility of the shipper and such issues will be between the shipper and the client.
2. LIMIT OF LIABILITY: It is understood that there are always going to be some missed shots or unprinted photographs. The utmost care is made in the choice, exposure, development, and delivery of your photographs. In the event the photographer fails in any way to comply with the terms of this agreement, whether from accident, illness, negligence, artistic choice, abilities, mechanical and/or processing failure, loss by Parcel Carrier, illness, act of God, or any other avoidable or unavoidable action, the Studio liability will be limited to refunds of money paid along with the return of all photographs and files to the photographer. Even if a list of photos requested is submitted, there is no guarantee they can all be made.
3. EXCLUSIVE PHOTOGRAPHER: It is understood that we shall be the official photographer for this wedding. Family, friends and guests may take snapshots, but no one else may be appointed to function as an official photographer of the day's events. It is up to Client to decide if and when their guests may take snapshots. The photographer is not responsible for guests camera flashes ruining the photographs created for the Client by the Photographer.
4. APPOINTMENT OF AN ASSISTANT: The photographer will need a point of contact who knows friends and family members and can help organize them for photographs. Choose someone with a take-charge attitude who can help the photographer. If you have a list of photos to be taken, you must have someone helping the photographer. You can ask for the option pay more money for the photographer to pay for an assistant. A photographer can not juggle thousands of dollars worth of camera equipment and check off a list at the same time.
5. TIME ALLOTTED FOR PHOTOGRAPHS: You are retaining a photographer who may do things a little differently. He will shoot many photographs. It is advised that you start your photographs early on the wedding day, at the time recommended by the photographer, probably three hours before the wedding. This planning will help you have a fun and stress-free wedding day. If you opt for a storybook style album, it is important to remember the photographer can not be in two places at once. If the bride wants shots taken of her getting ready, the photographer can not be setting up for group shots. If the photographer is retained for a period of time longer than agreed upon as described at the end of this document, the rate shall be $150 per hour.
6. OWNERSHIP OF IMAGES: It is agreed that ownership rights of the color film negatives or digital images will remain with the Photographer. Photographer retains all copyrights unless otherwise agreed in writing.
7. DISPLAY PROMOTION: It is agreed that the Photographer may display and use photographs from the wedding day, bridal and engagement portraits for advertising, display, website and internet promotion, photographic contests, bridal shows, public display as in malls, photography books, photography instructional books, store fronts, window displays, studio display, television advertising, magazine advertising and any other purposes thought proper by the Photographer.
8. RESERVATION FEE & PAYMENT SCHEDULE: Upon signature, the photographer reserves the time and date agreed upon, and written below, and will not make other reservations for that time and date. For this reason, the Reservation Fee of $750 is non-refundable, even if date is changed or wedding cancelled for any reason, including acts of God, fire, strike, extreme weather, or a run-away bride or groom. Reservation fee is to be paid at time of parties signing this contract. The amount is applied towards the cost of the wedding photography package. Client understands and agrees that the entire amount owed for the wedding photography package described in this Contract is due no later than two weeks BEFORE the Wedding Day. Client agrees without the full balance paid by this time, the Photographer will NOT photograph the Wedding Day described on this Contract with no liability to Photographer and a loss of Reservation Fee by Client. Wedding package price does not include taxes. Bounced checks void any agreement and may be prosecuted.
9. GUARANTEED DELIVERY TIME: Client understands and agrees that certain wedding albums may take between six to eight weeks for delivery.
10. INDEPENDENT CONTRACTOR: This Contract is not to be construed as an employment agreement in any way. The Photographer functions as an independent contractor and has liability insurance protection. We operate under a City of Greenville, SC business license and others as needed, depending on location requirements.
11. GOVERNING LAW OF CONTRACT: This Contract shall be governed by the laws of the State of South Carolina.
12. CANCELLATION/RESCHEDULE: In the event the Client must cancel the services for wedding photography on this Contract, the Photographer agrees to refund all money paid, excluding the Reservation Deposit. Any refunds may take up to thirty calendar days to process and provide to Client. Client must provide Photographer notice of cancellation in writing. Rescheduling will require a new reservation deposit if the new wedding date is available. The reservation deposit of previous wedding date may be applied towards new wedding date at the photographer’s discretion. Client must provide Photographer notice of rescheduling in writing.
13. ALTERNATE PROFESSIONAL PHOTOGRAPHER: In the unlikely event the Photographer cannot perform due to illness, injury, or any other cause beyond his control, the Photographer may provide an alternate photographer to perform under this Contract. The Photographer warrants that the alternate photographer is a competent and experienced wedding photographer.
